1. Website and Booking Information

Flagtown Co makes reasonable efforts to ensure that the information on our website is accurate and current. This includes property descriptions, photographs, amenities, availability, pricing, and other information.

However, information may change from time to time. We reserve the right to correct errors, update information, change availability, and modify property features or amenities when necessary.

Photographs are intended to provide a general representation of our properties. Furnishings, décor, landscaping, views, and other details may vary.

2. Reservations

Reservations may be made through the booking system available on our website.

When making a reservation, you agree to provide accurate and complete information, including your name, contact information, dates of stay, number of guests, and payment information.

A reservation is confirmed only after the required payment has been successfully processed and you receive a reservation confirmation from Flagtown Co.

You are responsible for reviewing your reservation confirmation and notifying us as soon as possible if you notice an error.

3. Pricing and Fees

All applicable pricing, taxes, cleaning fees, and other required charges will be displayed during the reservation process whenever reasonably possible.

Flagtown Co reserves the right to correct pricing or listing errors. If a significant pricing error occurs, we may contact you to provide the option to confirm the reservation at the correct price or cancel the reservation.

4. Payment

Payments made through our website are processed through Stripe, a third-party payment processor.

By submitting a reservation and payment, you authorize the applicable charges associated with your booking.

Flagtown Co does not store your complete credit or debit card information.

Stripe may collect and process payment and transaction information according to its own terms and privacy practices.

5. Cancellation and Refunds

Cancellation and refund policies may vary depending on the property, reservation dates, and rate selected.

The cancellation policy presented during the booking process and included with your reservation confirmation will apply to your reservation.

When a refund is approved, it will generally be returned to the original payment method.

Refund processing times may vary depending on Stripe, your bank, or your credit-card provider.

6. Changes to Reservations

Requests to modify a reservation, including changes to dates or the number of guests, are subject to availability and Flagtown Co’s applicable policies.

Changing the dates of a reservation may result in a change to the total reservation price.

A reservation change is not guaranteed until it has been confirmed by Flagtown Co.

7. Check-In and Check-Out

Guests must follow the check-in and check-out times and instructions provided with their reservation.

Early check-in or late check-out is not guaranteed and requires prior approval.

Additional charges may apply for unauthorized late check-outs or other circumstances that require additional cleaning, maintenance, or interfere with another reservation.

8. Occupancy and Visitors

The number of overnight guests may not exceed the maximum occupancy listed for the property.

Guests are responsible for ensuring that everyone in their party follows Flagtown Co’s rules and policies.

Visitors who are not included in the reservation may be subject to property-specific restrictions.

Unauthorized parties, events, or gatherings are not permitted without prior written approval from Flagtown Co.

9. Property Rules

11. Pets

Pets are not permitted unless specifically approved by Flagtown Co in advance.

12. Hot Tub Rules and Safety

Some Flagtown Co accommodations provide access to a hot tub. Hot tub use is a privilege and is subject to the following rules.

Hot Tub Hours

The hot tub is available for use between:

8:00 AM and 10:00 PM

Guests must not use the hot tub outside of these hours.

Authorized Guests Only

The hot tub is intended exclusively for registered Flagtown Co guests and may not be used by unauthorized visitors.

The maximum occupancy of the hot tub area is 10 people at one time.

Children and Minors

Guests under 18 years of age must be supervised by a responsible adult at all times while using or being around the hot tub.

Parents and guardians are responsible for determining whether hot tub use is appropriate for children in their care.

Shower Before Use

Guests should shower before entering the hot tub.

This helps maintain clean and sanitary water for everyone using the amenity.

No Glass

Glass containers are strictly prohibited in or around the hot tub area.

Guests should use only appropriate non-glass containers.

Towels

Hot tub towels are provided for guest use.

Additional towels may be available in the designated bathroom or hot tub area. Guests should return used towels to the designated location after use.

Hot Tub Cover

Guests must replace and properly secure the hot tub cover after each use.

The cover helps maintain the temperature and cleanliness of the hot tub and protects the equipment.

Hot Tub Controls

Guests must use the hot tub controls and touchscreen according to the instructions provided at the property.

Do not attempt to remove, alter, repair, or tamper with hot tub equipment.

General Safety

Guests should:

  • Enter and exit the hot tub carefully.
  • Avoid running around the hot tub area.
  • Follow all posted instructions.
  • Stay hydrated.

  • Never use the hot tub while impaired to the point that safe use is compromised.
  • Exit the hot tub immediately if you feel dizzy, faint, overheated, or unwell.
  • Notify Flagtown Co immediately of any equipment problem, damage, injury, or unsafe condition.

Guests should consult a physician regarding hot tub use if they have any medical condition or concern that may make hot water exposure unsafe.

Hot Tub Damage and Misuse

Guests may be responsible for costs resulting from misuse, damage, contamination, or violation of the hot tub rules.

Tampering with equipment, intentionally damaging the hot tub, or using the hot tub in a manner that creates an unsafe condition is prohibited.

13. Hot Tub Release of Liability and Assumption of Risk

Guests acknowledge that hot tub use involves inherent risks, including but not limited to:

  • Slips and falls
  • Slippery surfaces
  • Drowning or near-drowning
  • Overheating
  • Dehydration
  • Dizziness or fainting
  • Changes in blood pressure
  • Burns or discomfort from excessive water temperature
  • Injury resulting from improper use
  • Injury resulting from entering or exiting the hot tub
  • Risks associated with alcohol or other substances
  • Risks associated with unsupervised children
  • Other risks inherent to the use of hot tubs and recreational amenities

By using the hot tub, guests voluntarily assume the ordinary and inherent risks associated with its use.

Guests are responsible for determining whether they and members of their party are physically capable of safely using the hot tub.

To the fullest extent permitted by applicable law, guests agree to release and hold harmless Flagtown Co, its owners, operators, employees, agents, and authorized representatives from claims for injury, loss, or damage arising from risks that the guest knowingly and voluntarily assumes or from the negligent or wrongful conduct of the guest or members of the guest’s party.

This release does not apply to claims arising from conduct for which liability cannot legally be released, waived, or limited under applicable law.

Nothing in these Terms & Conditions is intended to waive or limit any legal right or protection that cannot legally be waived.

14. Damage and Additional Charges

Guests are responsible for damage caused by themselves or members of their party beyond ordinary wear and tear.

Additional charges may apply for:

  • Property damage
  • Missing or damaged items
  • Excessive cleaning
  • Smoking violations
  • Unauthorized pets
  • Unauthorized guests or events
  • Lost keys or access devices
  • Damage to hot tub equipment

15. Personal Belongings

Guests are responsible for their personal belongings during their stay.

Flagtown Co is not responsible for lost, stolen, or damaged personal property except where responsibility cannot legally be excluded.

Guests should take reasonable precautions to secure valuables and personal belongings.

If an item is accidentally left behind, guests may contact Flagtown Co to arrange its return. Shipping or handling costs may apply.

16. Maintenance and Amenities

We make reasonable efforts to ensure that our properties and amenities are available and functioning properly.

Occasionally, circumstances beyond our control may result in a temporary loss of an amenity or service, including:

  • Water interruptions

  • Weather

  • Use of hot tubs and other recreational amenities
  • Temporary interruptions to utilities or amenities
  • Activities involving children or other members of your party
  • Other ordinary risks associated with occupying and using a residential property

You voluntarily assume responsibility for the reasonable risks associated with your use of the property and its amenities.

You agree to use the property and all amenities responsibly and in accordance with all posted instructions, safety guidelines, and property rules.

You are responsible for exercising reasonable care for yourself and for members of your party, including children and guests you invite onto the property.

To the fullest extent permitted by applicable law, you agree to release and hold harmless Flagtown Co and its owners, operators, employees, agents, and authorized representatives from claims for personal injury, property damage, or other loss arising from your use or occupancy of the property or its amenities, to the extent such claims result from risks that you knowingly and voluntarily assume or from the negligent or wrongful conduct of you or members of your party.

This release does not apply to claims arising from conduct for which liability cannot legally be released, waived, or limited under applicable law, including liability that cannot legally be excluded because of gross negligence, willful misconduct, or other non-waivable conduct.

Nothing in these Terms & Conditions is intended to waive, release, or limit any legal right or protection that cannot lawfully be waived or limited.

23. Indemnification

To the fullest extent permitted by applicable law, you agree to indemnify and hold harmless Flagtown Co, its owners, operators, employees, agents, and authorized representatives from claims, damages, losses, liabilities, and reasonable expenses arising from:

  • Your negligent or intentional conduct
  • The negligent or intentional conduct of members of your party or unauthorized visitors
  • Damage caused to the property or its contents by you or members of your party
  • Your unauthorized use of the property or its amenities

This indemnification obligation does not apply to the extent that a claim results from conduct for which Flagtown Co is legally responsible or where indemnification cannot legally be required.

24. Guest Acknowledgment

By completing a reservation through the Flagtown Co website, you acknowledge that you have had an opportunity to review these Terms & Conditions and agree to comply with them.

You further acknowledge that you are responsible for informing all members of your party of applicable property rules and safety requirements.

Where a separate rental agreement or guest acknowledgment is provided, you may be required to affirmatively acknowledge and accept that agreement before completing your reservation.

25. Force Majeure

Flagtown Co is not responsible for failure or delay in providing services caused by circumstances beyond our reasonable control.

These circumstances may include natural disasters, wildfires, severe weather, government restrictions, utility failures, emergencies, property damage, or other unforeseeable events.

If circumstances outside our control affect your reservation, we will make reasonable efforts to communicate with you and determine what options may be available.

26. Limitation of Liability

To the fullest extent permitted by applicable law, Flagtown Co is not responsible for indirect, incidental, special, or consequential losses arising from use of our website or services.

Nothing in these Terms & Conditions is intended to exclude or limit liability that cannot legally be excluded or limited.

27. Termination of a Stay

Flagtown Co may terminate a reservation or require a guest to leave a property when reasonably necessary due to:

  • Material violation of these Terms & Conditions
  • Exceeding occupancy limits
  • Unauthorized parties or events
  • Illegal activity
  • Significant property damage
  • Threatening, abusive, or dangerous conduct
  • Repeated disturbances
  • Fraudulent or materially inaccurate reservation information

Where a reservation is terminated because of a guest’s violation of these Terms & Conditions, the guest may not be entitled to a refund, except where required by law.
